By accessing or using the Digital Dockets platform (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.
The Service is operated by Digital Dockets LLC ("Digital Dockets," "we," "us," or "our"), a Michigan limited liability company.
Digital Dockets is a technology platform that facilitates the delivery of process serving services in Michigan. The Service allows clients to submit service requests, receive quotes, upload documents, track job status, and receive affidavits. Digital Dockets is not a law firm and does not provide legal advice.
Use of the Service does not create an attorney-client relationship between you and Digital Dockets. Digital Dockets does not provide legal advice, legal representation, or legal opinions. If you require legal counsel, consult a licensed attorney.
By using the Service as a client, you represent and warrant that:
Fees are quoted per job based on service type, complexity, and any add-ons requested. All fees are in United States Dollars (USD).
Fees are earned upon attempt of service, not upon successful service. Payment is due upon completion unless other terms are agreed to in writing.
Refund terms are described in our Refund Policy.
Digital Dockets provides service level guidelines (Standard, Rush, Same-Day, etc.) but does not guarantee service by any specific date or time. Legal deadlines are the sole responsibility of the client. Digital Dockets is not liable for missed court deadlines.
Process servers on the Digital Dockets platform are independent contractors, not employees of Digital Dockets. Digital Dockets does not control the specific means or methods by which process servers perform their work, provided such work complies with applicable law and the platform's requirements.
You may not use the Service to:
All content, features, and functionality of the Service (including software, text, graphics, logos) are the property of Digital Dockets LLC and are protected by copyright, trademark, and other laws.
The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Digital Dockets LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service.
Our total liability for any claim arising from or related to the service shall not exceed the amount you paid to us for the specific job giving rise to the claim.
You agree to indemnify and hold harmless Digital Dockets LLC, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
Any dispute arising from these Terms or the Service shall first be attempted to be resolved informally by contacting us. If informal resolution fails, disputes shall be resolved through binding arbitration in Macomb County, Michigan, or in the state or federal courts located in Macomb County, Michigan.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, provisions of these Terms that by their nature should survive (including limitation of liability, indemnification, governing law) shall survive.
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
Process serving is a service-based industry. All service fees are earned once a serve attempt has been made, regardless of the outcome. Attempts include but are not limited to visits to the subject's address, verified location checks, and skip trace activity.
Refunds under this section are issued at Digital Dockets' sole discretion.
Refund requests must be submitted in writing within thirty (30) days of the charge. Include:
Approved refunds are issued to the original payment method within 5 to 10 business days after approval. Refunds may take additional time to appear depending on your bank or card issuer.
Add-ons such as stakeouts, notarized affidavits, court filing, and e-filing are subject to the same policy. Add-ons are earned upon performance. Add-ons paid to third parties (courts, notary services, filing systems) that have already been remitted are non-refundable.
If you dispute a charge with your bank or card issuer without first attempting resolution with Digital Dockets, we reserve the right to suspend your account and pursue collection of any legitimate outstanding balance.
